REQUIREMENT TO MAKE EFFORTS TO OBTAIN MAINTENANCE

You have recently claimed and been awarded One-Parent Family Payment (OFP).

As you have been already advised, one of the conditions for receiving this payment is that there is a requirement on an unmarried person to make reasonable efforts to seek maintenance from the other parent of their child.
If you have not already made arrangements with the other parent of your child regarding the payment of maintenance, you are now requested to:

  • Name the other parent of your child, if you have not already done so, and state his/her address, date of birth and current employment, if known.

YOU SHOULD NOTE THAT THE PERSON YOU NAME AS THE OTHER PARENT IS NOW LEGALLY OBLIGED TO CONTRIBUTE TO THE DEPARTMENT TOWARDS THE COST OF THE ONE-PARENT FAMILY PAYMENT BEING PAID TO YOU.

  • Contact the other parent of your child and ask him/her to pay maintenance.

You should inform the Department of any maintenance arrangement agreed with the other parent.

However, if your efforts to obtain maintenance are not successful, you may be required to furnish proof to the Department that you made reasonable efforts to obtain such maintenance.

Such proof would consist of a copy of a maintenance summons or evidence that you and the other parent of your child were involved in a formal mediation process (which includes negotiations about the financial support of the dependant child).

The Department will keep your efforts to obtain maintenance under review and may contact the other parent directly if s/he does not co-operate in paying maintenance, or if s/he is not contributing sufficiently in relation to his/her current financial situation.

You should also note that where it is reasonable for you to make efforts to obtain maintenance, you may be disqualified from receiving One-Parent Family Payment, if you do not co-operate in making such efforts.
